Principles for Processing Personal Data

1. Basic data

   1.1. The company AT personalistika, s.r.o. in its activities operates in accordance with Act no. 18/2018 on personal data protection, as amended, (hereinafter the "Act") and the Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter "the Regulation").

    1.2. The operator processing the personal data of the user is:

    (hereinafter "the Operator").

   1.3. The Operator has authorized a person responsible for personal data protection. Contact details of the Operator´s representative in charge:

   1.4. By personal data, we mean all information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a specific identifier, such as name, identification number, location data, network identifier or with reference to one or more specific elements of physical, physiological, genetic, mental, economic, cultural or the social identity of that natural person.

   1.5. The Operator performs activities in the business scope of Home Care Agency and Brokerage in the field of Services; these activities are also performed through the website https://www.fermeria.co.uk, and personal data are processed in the said area.

   1.6. These principles for processing personal data apply to the processing of personal data of persons interested in the services of the Operator provided through the website https://www.fermeria.co.uk (hereinafter the "Website") and registering on this Website, or using the services offered by the Operator. (hereinafter the "User").

   1.7. The Operator informs the Users of the Website that cookies are used for its operation. By clicking on the Website and registering on the Website, the User accepts the use of cookies. The User may block or delete cookies in his/her internet browser, but blocking cookies may limit the use of the Website.

1. 8.    1.8. When operating the website https://www.fermeria.co.uk, we use cookies to help us provide better services. Advertisements are also displayed to individual users according to their relevance and interest thus they become more valuable to the advertisers. When you visit the website, you as a user will be notified of the use of these cookies and you are asked to consent to the use of marketing cookies. By clicking the Consent button, you agree to the use of cookies for marketing purposes. You can withdraw your consent at any time in writing or electronically to the operator's data.

2. Legal basis and purpose of processing personal data

   2.1. The Operator processes your personal data that you provide as a User by filling in the registration and other forms (profile, advertisement) on the Website or the personal data that the Operator obtains during the performance of the contract (e.g. IP address, logos, cookies) through his activities or from the Operator´s technical operation on the web.

   2.2. Your identification, contact details and data necessary for the performance of the contract are processed by the Operator in order to provide you with proper services which you have expressed your interest in by registering. Without the provision of your essential personal data, the Operator would not be able to provide the services to you. In addition to the necessary data, the Operator also processes other data that you provide with your consent (e.g. a photograph).

   2.3. The purpose of the processing of personal data for which your personal data is intended is:

• creation of registration (name, surname, telephone number, e-mail address) and your order to broker care work in Austria (required personal data necessary for successful brokerage - area of care, name, surname, town, telephone number, gender, information on the criminal record, information on trade licence in Austria, its date of establishment if applicable, expected salary, skills and work experience, German language skills, educational qualification, other courses and certificates, previous care experience, number of years of experience if applicable, information, whether the User is a smoker and whether he suffers from allergies) and subsequently the exercise of rights and obligations arising from the contractual relationship between you and the Operator,

• creation of registration (name, surname, telephone number, e-mail address) and your Profile for the purpose of finding a person to whom you provide your service (required personal data necessary for the success of the Profile - qualification, location, frequency of care, age, work experience, educational qualification, other courses and certificates, data on driving license, required salary, maximum number of persons receiving care at the same time, data on smoking, data on accepting pets, data on foreign language skills, experience with diagnoses - physical, mental, data on performing other chores and tasks) and subsequently the exercise of rights and obligations arising from the contractual relationship between you and the Operator,

• creation of registration (name, surname, telephone number, e-mail address) and placing an advertisement for the purpose of finding a Carer (required personal data necessary for the success of the advertisement - title of the advertisement, start date, location, offered pay, required qualification, number and the age of the persons receiving care and the option to ask for additional data – e.g. required work experience, pets) and subsequently the exercise of rights and obligations arising from the contractual relationship between you and the operator,

• sending business announcements and performing other marketing activities (e.g. events, competitions, etc.) regarding services provided by the Operator.

2.4. The legal basis for the processing of your personal data is:

          a) Performance of the contract between you and the Operator,

         b) Legitimate interest of the Operator in the direct marketing activity (e.g. sending service offers to Users to whom the services are provided or during valid registration),

      c) Your express consent to the processing of photographic or health data (applicable for persons with severe disabilities) for the purpose of providing services by the Operator (performance of the contract),

        d) Your consent to the processing of data for the purpose of direct marketing activities (e.g. sending service offers to Users for whom services are no longer provided or whose registration has expired).

   2.5. The provision of personal data is a contractual requirement and a requirement that is essential for closing the contract, therefore, refusing to provide the personal data may result in rejecting the registration and refusing to enter into a contract.

   2.6. The User may, at his discretion, include his photograph in his registration data, whereby the User publishes his photograph himself. The User is not allowed to use a photo that shows another person. The User can delete the photo in their registration details at any time.

   2.7. By creating a Profile or placing an Advertisement on the Operator's website, the User accepts the publication of the data he has entered within the creation of the Profile or Advertisement on the Website, whereby the Profile and the Advertisement are also visible to third parties. The data provided in the Profile or Advertisement can be amended by the User at any time after logging in to the Website.

3. Recipients of personal data

   3.1. The recipients of your personal data are as follows:

    • persons working for the Operator as employees or on the basis of a different contract with the Operator and participating in the performance of the contract between you and the Operator,

    • persons providing services necessary for the operation of the Website, the Operator's software and other services related to the operation of the Website,

      • persons providing accounting, tax and legal services for the Operator.

A public authority that processes personal data on the basis of a special regulation or an international agreement by which the Slovak Republic is bound shall not be considered a recipient.

   3.2. The Operator declares that only persons contracted by him have access to the personal data.

   3.3. The Operator does not intend to transfer any personal data to a third country, i.e. outside the European Union or to an international organization.

   3.4. The Operator does not perform automatic individual decision-making or profiling in accordance with § 28 pars. 1 and 4 of Act no. 18/2018 Coll. on Personal Data Protection.

4. Retention period of personal data

   4.1. The Operator stores personal data in according to the type of personal data and the purpose for which they are stored:

       • for the time necessary for the exercise of rights and obligations arising from the contractual relationship between you and the Operator,

     • for the period necessary to file claims from the contractual relationship between you and the Operator, and for archiving for tax and accounting purposes (for a maximum period of 10 years from the termination of the contractual relationship),

      • until the withdrawal of the consent to the processing of personal data for marketing purposes, for a maximum of 2 years if the personal data are processed on the basis of the consent.

   4.2. After completing the period of retention of personal data, the Operator shall delete the personal data.

5. Rights related to personal data

   5.1. Regarding your personal data, according to the Act you have:

•        • the right to request access to your personal data from the Operator,

•        • the right of rectification of your personal data,

•        • the right to erasure of your personal data,

•        • the right to restrict the processing of your personal data,

•        • the right to object to the processing of your personal data,

•        • the right to transmit your personal data,

•        • the right to withdraw your consent to data processing at any time in writing or electronically,

•        • the right to submit a motion to initiate proceedings to the Office for Personal Data Protection of the Slovak Republic if you believe that your rights under the Act have been affected.

   5.2. The Operator will notify the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 82007 Bratislava 27, Slovakia, e-mail: statny.dozor@pdp.gov.sk of a violation of personal data protection not later than 72 hours after having become aware of it, through the specified form; this does not apply, if the breach of personal data protection is not likely to lead to a risk to the rights of the individual. The Operator is obliged to notify the data subject without undue delay of a personal data breach, if such a breach of personal data protection likely to result in a high risk to the rights of a natural person.

6. Conditions of Personal Data Protection

   6.1. The Operator declares that he has implemented all appropriate technical and organizational measures to ensure the protection of personal data:

      a) anonymization and encryption of personal data,

      b) technical securing of personal data processing systems,

      c) backup of personal data,

      d) regular assessment of the effectiveness of technical and organizational measures.

   6.2. Technical measures ensure safe storage of data in electronic form, in particular securing computers, the Website with a login name and password, and regular maintenance of the Website. Technical physical measures to ensure safe storage of data in paper form include locking the premises, locking storage cabinets and access only to authorized persons.

7. Other conditions

   7.1. Sending a request for registration via the online form at https://www.fermeria.co.uk you confirm that you have read the conditions of personal data processing and personal data protection and that you consent to them.

   7.2. The Operator is entitled to change these Principles. The amended version of the Principles for Processing Personal Data will be published on the website and in addition you will be sent a new version of these conditions to your e-mail address provided to the Operator.

7. 4. These Principles for Processing Personal Data shall enter into force on 22 August 2018.
